A Federal High Court
in Abuja has struck out the application by the Independent National
Electoral Commission (INEC) to serve the recall petition against Senator
Melaye by substituted means.
Justice Nnamdi Dimgba on Thursday struck out
the application after INEC counsel, Yunus Ustaz (SAN) applied to withdraw
it.
Justice Dimgba also ordered the transfer of
all pending applications to the Court of Appeal.
Melaye (APC, Kogi West) had earlier appealed
the judgement of the court on September 11, which gave INEC go ahead to
commence his recall process.
