Court acquits lovers after four years in prison

An Ekiti State High Court sitting in Ado-Ekiti has discharged and acquitted two lovers, Kenneth George and Evelyn Okechukwu, after they spent four years in prison on an allegation of theft.

Justice Isaac Akintayo held that after listening to the prosecution and defence witnesses, “no reasonable court or tribunal will convict them (accused persons).”
Akintayi said, “I hold that the prosecution had failed to prove its case against the accused persons as required by Law.”
Akintayo, thereafter, ordered that the accused persons be discharged and acquitted on all the five counts of robbery and conspiracy.
Earlier, the state counsel, Mr. Gbenga Daramola, had told the court that the accused persons committed the offence on December 12, 2010 on Igbole Road, Ido-Ekiti.
The prosecutor said the offence contravened Section 1(2)(a) of the Robbery and Firearms (Special Provisons)Act, Cap R 11, Vol. 14, Laws of the Federation of Nigeria, 2004.
In his argument, the defence counsel, Mr. Kola Kolade, urged the court to discharge and acquit his clients since the prosecution counsel had failed to prove its case against them.
